1.1 Welcome to Jp English Academy, an online platform providing English language education services. 

1.2 Our services include English classes, one-on-one classes, conversation sessions, translation and proofreading services.

1.3 These Terms and Conditions govern your use of the Jp English Academy website and the services we offer. By accessing or using our website and services, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, you must not use our website or services.

Payment and Billing

2.1 Jp English Academy accepts payments through various secure online payment methods, including WOMPI, PAYU, PAYPAL, and Bank Transfer, as well as more than 20 internal payment methods. The exact payment methods available will be specified on the website at the time of purchase.

2.2 All payments must be made in advance for the services you have chosen.

2.3 Invoice Terms: Upon payment, you will receive an invoice for the services purchased, which will include a description of the services, the total amount paid, and the payment method used.

2.4 Late Payment Fees: In the event of a late payment, Jp English Academy reserves the right to charge late payment fees. The amount and terms of such fees will be specified in the invoice or on the website. By submitting your payment information and completing the payment process, you represent and warrant that you have the authority to use the payment method you have selected. Jp English Academy shall not be responsible for any overdraft or insufficient funds fees or any other related charges that may be incurred by you as a result of the payment.

Turnaround Times and Delivery

3.1 The turnaround time for each type of translation service offered by Jp English Academy may vary based on the complexity and length of the material, as well as other factors. The expected turnaround time for each service will be specified on the website or communicated to you at the time of purchase.

3.2 Delivery of the translated materials will be made through a secure online file transfer service, or by email, as specified at the time of purchase. Jp English Academy shall use reasonable efforts to deliver the translated materials within the estimated turnaround time, but does not guarantee delivery by a specific date or time.

3.3 In the event of a delay, Jp English Academy will use reasonable efforts to promptly notify you and to provide an updated delivery schedule. You understand and agree that Jp English Academy shall not be liable for any damages or losses resulting from a delay in delivery.

Refund and Cancellation Policy

4.1 Jp English Academy allows clients to request a refund within two (2) days of purchase for any unused services. To request a refund, clients must contact Jp English Academy in writing and provide a detailed explanation of the reason for the request.

4.2 Jp English Academy reserves the right to approve or deny refund requests in its sole discretion. If a refund is approved, Jp English Academy will process the refund within a reasonable time period, not to exceed thirty (30) days.

4.3 In the event that a client wishes to cancel an order for English classes, one-on-one classes, conversation, translation, or proofreading services, the client must contact Jp English Academy in writing and provide a detailed explanation of the reason for the cancellation.

4.4 Jp English Academy reserves the right to approve or deny cancellation requests in its sole discretion. If a cancellation is approved, Jp English Academy will refund the client for any unused services, subject to the terms and conditions of the Refund and Cancellation Policy.

4.5 By using Jp English Academy’s services, you acknowledge and agree to the terms of this section on the Refund and Cancellation Policy.

Quality Assurance

5.1 Jp English Academy takes great care to ensure the quality of all its services, including English classes, one-on-one classes, conversation, translation, and proofreading services.

In the event that you are not satisfied with the quality of the classes, please contact Jp English Academy within a reasonable time after the completion of the classes. Jp English Academy will then review the classes and, at its discretion, provide additional classes or offer a full or partial refund.

5.2.2. One-on-One Classes

Jp English Academy uses reasonable efforts to provide high-quality one-on-one classes. In the event that you are not satisfied with the quality of the classes, please contact Jp English Academy within a reasonable time after the completion of the classes. Jp English Academy will then review the classes and, at its discretion, provide additional classes or offer a full or partial refund.

5.2.3. Conversation

Jp English Academy uses reasonable efforts to provide high-quality conversation services. In the event that you are not satisfied with the quality of the conversation services, please contact Jp English Academy within a reasonable time after the completion of the services. Jp English Academy will then review the services and, at its discretion, provide additional conversation services or offer a full or partial refund.

5.2.4. Translation Services

Jp English Academy uses reasonable efforts to provide high-quality translation services. To request a review or correction of the translated materials, please contact Jp English Academy within a reasonable time after receipt of the translated materials. Jp English Academy will then review the materials and, at its discretion, correct any errors or inaccuracies.

5.2.5. Proofreading

Jp English Academy uses reasonable efforts to provide high-quality proofreading services. To request a review or correction of the proofread materials, please contact Jp English Academy within a reasonable time after receipt of the proofread materials. Jp English Academy will then review the materials and, at its discretion, correct any errors or inaccuracies. By using Jp English Academy’s services, you acknowledge and agree that Jp English Academy shall not be liable for any damages or losses resulting from errors or inaccuracies in the services provided.

Confidentiality and Data Protection

6.1 Jp English Academy takes the protection of client information and data very seriously. Jp English Academy implements measures to ensure the confidentiality and security of all information and data received from clients in connection with its English classes, one-on-one classes, conversation, translation, and proofreading services.

6.2 Jp English Academy requires all employees, contractors, and other parties who have access to client information and data to sign non-disclosure agreements. These agreements prohibit the unauthorized use, disclosure, or dissemination of client information and data.

6.3 Jp English Academy implements physical, technical, and administrative security measures to protect client information and data from unauthorized access, theft, loss, or destruction. These measures include, but are not limited to, secure servers, firewalls, encryption, and restricted access to client information and data.

6.4 In the event that Jp English Academy is required by law to disclose client information and data, Jp English Academy will take reasonable steps to notify the client before making such disclosure, unless prohibited by law.

6.5 By using Jp English Academy’s services, you acknowledge and agree that Jp English Academy shall use reasonable efforts to protect the confidentiality and security of your information and data. However, Jp English Academy shall not be liable for any damages or losses resulting from unauthorized access to, theft of, or destruction of client information and data.

Liability and Indemnification

7.1 Jp English Academy provides its English classes, one-on-one classes, conversation, translation, and proofreading services to clients in good faith and with reasonable care. Jp English Academy does not guarantee that the services provided will meet the client’s specific requirements or expectations.

7.2 Jp English Academy shall not be liable for any errors or omissions in the translation or any other services provided, unless such errors or omissions were caused by the gross negligence or willful misconduct of Jp English Academy.

7.3 The client shall indemnify, defend, and hold harmless Jp English Academy and its employees, contractors, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to the client’s use of Jp English Academy’s services.

7.4 The client shall promptly notify Jp English Academy in writing of any claims or demands that may be made against Jp English Academy and shall cooperate fully with Jp English Academy in the defense of any such claims or demands. Jp English Academy may, at its option and expense, participate in the defense of any such claims or demands.

7.5 This section on liability and indemnification shall survive the termination or expiration of these Terms and Conditions and shall remain in full force and effect.

7.6 By using Jp English Academy’s services, you acknowledge and agree to the terms of this section on liability and indemnification.

Changes and Revisions

8.1 Jp English Academy provides translation, proofreading, and other language services to clients with the goal of delivering high-quality work that meets the client’s needs and expectations.

8.2 In the event that a client wishes to request changes or revisions to the translated documents, the client must contact Jp English Academy in writing and provide a detailed explanation of the requested changes or revisions.

8.3 Jp English Academy will review the request for changes or revisions and provide a quote for the associated costs, if any. If the client agrees to the quoted costs, Jp English Academy will make the requested changes or revisions to the translated documents.

8.4 The client acknowledges and agrees that any changes or revisions to the translated documents may result in additional fees and that Jp English Academy is not obligated to provide changes or revisions at no cost.

8.5 By using Jp English Academy’s services, you acknowledge and agree to the terms of this section on Changes and Revisions.

Intellectual Property Rights

9.1 Jp English Academy provides translation, proofreading, English classes, one-on-one classes, conversation, and other language services to clients. The translated materials, proofread documents, class materials, and other language services provided by Jp English Academy may contain proprietary information and intellectual property belonging to the client.

9.2 Jp English Academy acknowledges that it has no ownership rights in any such proprietary information or intellectual property, and that all such rights remain with the client.

9.3 Jp English Academy agrees to use commercially reasonable efforts to maintain the confidentiality of the client’s proprietary information and intellectual property and to prevent unauthorized use or disclosure thereof. Jp English Academy agrees to take all necessary steps to ensure that its employees, agents, and contractors maintain the confidentiality of the client’s proprietary information and intellectual property.

9.4 In the event that Jp English Academy uses any third-party tools or resources in providing its services, Jp English Academy will comply with all applicable license terms and will not use such tools or resources in a manner that infringes on the intellectual property rights of any third party.

9.5 By using Jp English Academy’s services, you acknowledge and agree to the terms of this section on Intellectual Property Rights.

Dispute Resolution

10.1 In the event of a dispute arising out of or relating to Jp English Academy’s services, the parties agree to use their best efforts to resolve the dispute amicably. If the parties are unable to resolve the dispute amicably, they agree to submit the dispute to mediation or arbitration, at the election of either party. The mediation or arbitration shall be conducted in accordance with the rules of the Colombian Chamber of Commerce or a similar organization, as agreed upon by the parties.

Governing Law

11.1 These terms and conditions and any dispute arising out of or relating to Jp English Academy’s services shall be governed by and construed in accordance with the laws of Colombia. The parties agree to submit to the exclusive jurisdiction of the courts located in Colombia.

Changes to the Terms

12.1 Jp English Academy reserves the right to make changes to these terms and conditions at any time, in accordance with the regulations set forth by the government of Colombia, for any reason, and without notice to clients. The latest version of the terms and conditions will always be available on the Jp English Academy website. Clients are encouraged to review the terms and conditions periodically for any updates or changes. By using Jp English Academy’s services, clients acknowledge and agree to the terms and conditions set forth in the most current version of these terms and conditions.
